Terms of Service

These Terms are a binding agreement between you and Reapertoire, a service operated by Roman Kozdrowicz ("Reapertoire", "we", "us"). By downloading or using the Reapertoire app (the "App") or related services (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

2. Your account

You need an account to use most features. You agree to provide accurate information, to keep your login credentials secure, and that you are responsible for activity under your account. Authentication is handled by Amazon Cognito. Accounts are either personal ("enjoyer") accounts or brand accounts; brand accounts must only be created by, or with the permission of, the brand they represent.

3. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use.

4. Reapertoire Pro & subscriptions

5. Your content and the community catalog

6. Feed, comments, and follows

7. Community events

8. Acceptable use

You agree not to post or do anything that is unlawful, hateful, harassing, threatening, sexually explicit, violent, defamatory, or otherwise objectionable, and not to: impersonate others; post other people's private information; post spam, scams, or unsolicited advertising; post fake, misleading, or dangerous events; upload others' copyrighted material without permission; manipulate ratings or reviews; scrape, reverse-engineer, or interfere with the Service. Content that promotes the consumption of dangerous quantities of spicy food or "challenges" that risk harm is not allowed. We have zero tolerance for objectionable content or abusive users. We use an automated filter that blocks some offensive language in posts, comments, and events.

9. Reporting, blocking, and moderation

10. Notifications

If you allow push notifications, we may notify you about activity related to you (such as likes, comments, and replies), posts from people you follow, events near your town, featured sauces, and promotions. You can choose which notifications you receive in Settings → Notifications, or turn them off in your device settings.

11. Intellectual property

The App, its design, and the Reapertoire name and logo are owned by us and protected by law. Except for the license above, these Terms grant you no rights in our intellectual property. Town and place names are provided by GeoNames under the Creative Commons Attribution 4.0 License.

12. Health & safety disclaimer

Heat ratings, ingredient notes, allergen information, reviews, and event information are user-generated, not professional, medical, or safety advice. Always check the actual product label before consuming a product. Consume spicy foods at your own risk.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service, or any content or event posted by users, will be uninterrupted, error-free, accurate, or safe.

14. Limitation of liability

To the maximum extent permitted by law, Reapertoire will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service, from content posted by other users, or from your attendance at, or interactions with others at, any event. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

15. Termination

You may stop using the Service and delete your account at any time (Profile → Settings → Delete profile).

We may suspend, restrict, or permanently delete your account, and remove any of Your Content, at any time, for any reason or no reason, at our sole discretion, with or without notice — including, but not limited to, if you violate these Terms. This applies even if you have purchased Reapertoire Pro or any other subscription or in-app purchase. To the extent permitted by law, we are not obligated to provide a refund or any other compensation when we do so; refunds for purchases made through the App Store or Google Play are handled solely by Apple or Google under their policies.

Deleting your account — whether you do it or we do — does not cancel an auto-renewing subscription billed by Apple or Google. Cancel it in your App Store / Play Store account settings to stop future charges.

Sections that by their nature should survive termination will survive.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Continued use after changes means you accept them.

17. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws rules. Any dispute not resolved informally or in small-claims court will be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts. The Apple-required terms below also apply on iOS.

18. Apple App Store terms

These Terms are between you and Reapertoire only, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or handle warranty claims, and is a third-party beneficiary of these Terms with the right to enforce them. Your use of the App must comply with the Apple Media Services Terms of Use.

Privacy Policy

This policy explains what Reapertoire collects, why, who can see it, and your choices. We keep collection minimal — only what the App needs to work — and we do not sell your personal data, show ads in the App, or track you across other companies' apps and websites. The only advertising-related tool we use is the Meta SDK, solely to measure how well our own ads for Reapertoire work (see "Ad measurement" below).

Information we collect

Ad measurement

We advertise Reapertoire on Meta's platforms (Facebook and Instagram). To measure whether those ads lead to installs, the App includes the Meta SDK, which sends Meta a record when the App is installed and opened, along with basic device and app information (such as device model, OS version, app version, and IP address). It does not receive your account details, collection, posts, or other content.

The App does not ask for permission to track you, does not access your device's advertising identifier (IDFA), and does not use Facebook Login. On iOS, ad results are reported through Apple's privacy-preserving SKAdNetwork. Meta processes this data under its own Privacy Policy.

Device permissions

The App asks for access only when you use a feature that needs it, and you can change these at any time in your device settings:

What other users can see

Reapertoire is a social app. While your profile is public (the default), the following is visible to all signed-in Reapertoire users, not just people who follow you:

Like counts and upvote counts are shown as totals. Your email address, taste preferences, notification settings, the users you block, and reports you make are never shown to other users.

If you turn your profile private (Settings → Privacy & safety), your profile, reviews, posts, comments, and events are hidden from other users and you can't be followed. Sauces you've added to the shared catalog stay visible but aren't attributed to you, and your ratings still count toward anonymous averages. Anyone you block can't see your content, and you won't see theirs.

How we use your information

How your information is shared

Where data is stored

Your data is stored with the providers above, primarily on servers in the United States. If you access the Service from outside the U.S., your data will be transferred to and processed in the U.S. and other countries. Data is transmitted over encrypted connections.

Data retention

We keep your account and content for as long as your account is active, or until you delete it. Events are removed from listings once they end. Records of reports are kept as long as needed to keep the community safe. When you delete your account, we delete your data as described below. Backups and legally required records may persist for a limited period.

Your rights and choices

Depending on where you live (including the EU/UK under GDPR and California under the CCPA/CPRA), you may have the right to access, correct, delete, or export your personal data, and to object to or restrict certain processing. We do not sell personal data or use it to target ads to you. The Meta SDK only measures installs from our own ads and does not use your device's advertising identifier. You can edit most of your information yourself in Settings, make your profile private, and choose your notifications. To exercise any other right, email [email protected]. We will not discriminate against you for exercising these rights.

Deleting your account and data

You can delete your account at any time in the App (Profile → Settings → Delete profile). This permanently deletes your profile, photo, bio, town, taste preferences, reviews, notes, ratings, favorites, Feed posts (and the comments and likes on them), your comments and likes, your follows and followers, your events and event responses, your blocks, the reports you've made, and your notification tokens and settings, and removes your sign-in credentials. Sauces you contributed to the shared catalog remain (so the catalog stays intact for others) but are no longer attributed to you. You can also email [email protected] to request deletion.

We may also delete your account and its data at any time, for any reason, at our sole discretion — even if you have purchased Reapertoire Pro — as described in section 15 (Termination) of our Terms of Service. When we do, your data is deleted in the same way as above, except that we may keep records needed to enforce our Terms, prevent abuse (for example, stopping a removed user from re-registering), or comply with law. Deleting an account does not cancel a subscription billed by Apple or Google; manage that in your store account settings.

Children

Reapertoire is not directed to children under 13, and we do not knowingly collect personal data from them. If you believe a child has provided us data, contact us and we will delete it.

Changes to this policy

We may update this policy from time to time. We will change the "Last updated" date above and, for material changes, provide notice where appropriate.
